After staff at St Michaels, particularly in the northwest, let us know they were rostered on 9-hour sleepover shifts at times we wrote to your CEO Mike Thomas and told him this is not allowed under the workplace agreement.
Your agreement specifies that sleepovers are an eight hour period with a fixed allowance, so any rostered time exceeding eight hours must be recognised as time worked and paid accordingly.
We’ve asked St Michaels to undertake a full audit of workers’ wages and backpay all affected current and former staff for all unpaid wages - which is one hour’s pay for each 9-hour sleepover shift worked.
Anne-Louise Young from the management team has since written back saying:
"We are currently seeking advice from our legal counsel regarding this matter. I will be on leave next week, returning to the office on 1 March, and will make it a priority to follow this up on my return. I want to assure you that St Michael’s appreciates the seriousness of this matter and will ensure we follow up with any further information we may require from you."
We’ll update you during the first week of March.
If you have more questions about the sleepover backpay payment, please give HACSUassist a call.
