Your sick leave entitlement.

We’re aware that your facility manager has given a directive that you must provide a doctor’s certificate for any sick leave taken from 5 October to 6 October. However, this is not in line with what your enterprise agreement says about your sick leave entitlement.

It is important that you know your rights when it comes to your sick leave, and this is what your agreement says:

  • You are entitled to three (3) single days per financial year without supporting documentation such as a medical certificate or Statutory Declaration
  • You are entitled to three (3) single days per financial year without a medical certificate with a Statutory Declaration provided as evidence
  • After two (2) or more consecutive days of personal or carers leave you are required to produce a medical certificate

Your employer should not unfairly make you provide a medical certificate. We all know how difficult it can be to get into a doctor at the best of times and your employer should not be making things harder. We will be writing to Southern Cross Care to remind them what your enterprise agreement says about the evidence required for absences related to sick leave and carers leave.

If you have more questions about your entitlements to sick leave or carers leave, please call HACSUassist on 1300 880 032.
