If you were eligible for backpay due to working sleepovers that exceeded 8 hours, you would have received a letter from Multicap letting you know the amount you are owed.
Multicap’s method of calculating the backpay amount looks correct. However, Multicap have only gone back as far as 2017 and many members have said that they were doing sleepovers that exceeded 8 hours before that.
The statute of limitation period is about 2015. That means we can legally pursue backpay payments going back that far.
If you’ve received a letter with the amount you are getting back and you only did the sleepovers after 2017, then you can comfortably sign the document to receive your money.
However, if you were doing sleepovers between 2015 and 2017, you still can sign it if you like, but if you believe you were regularly doing sleepovers for more than 8 hours in that period (or were working other extra-long sleepovers) and can give evidence to that effect, then you may be entitled to more backpay and we recommend that you hold off signing anything until that figure is calculated and passed onto Multicap.
While our previous bulletin on the matter had a typo and stated that some members may be owed up to 6 figures worth of cash, several members will still most certainly get a tidy sum to pop back into their bank account. Well done to everyone who raised the issue with us so we could chase up Multicap and win payment for workers!
