While bargaining with The Hobart Clinic we continually raised concerns about how the proposed agreement could leave members disadvantaged, but they refused to make our changes and sent it to a vote anyway, with the majority of employees voting Yes to accept it.
The Fair Work Commission began assessing the agreement for fairness when compared to the award – known as the Better Off Overall Test (BOOT) – and found problems and now require THC to respond to several issues before they’ll approve it.
We had members' backs all along, and Hobart Clinic should have listened to us!
This means the new staff agreement will take longer to be approved and could take until November if the employer argues with the Fair Work Commission.
The Commission will likely require modifications to clauses or content already voted on, called ‘undertakings’, before giving approval so we’ll update members when there’s more information to share.
