How many times have you been told you only own your contracted hours and not your line?
The truth is, it’s not quite that simple, and these important details can be found in the Aged Care Deloraine Inc. Enterprise Agreement:
"If you are a Part Time Employee before commencing employment, the employer and the employee will agree in writing on a regular pattern of work including the number of hours to be worked each week, the days of the week the employee will work and the starting and finishing times each day."
This is why it’s very important to have a copy of your current contract.
If someone regularly works more than their guaranteed contracted hours they may request to have their hours reviewed annually and, if the review establishes a consistent pattern of greater hours is being worked, and it's operationally viable, the employer will offer the employee those additional hours as part of the guaranteed minimum number of hours.
If this happens be sure to sign a new contract reflecting the additional hours being added to the existing contracted hours.
If the increase in hours is a direct result of back-filling because other staff are on some sort of leave, or because of a temporary increase for a specific purpose, the employer does not have to adjust your contracted hours.
