HACSU takes Able Australia to the Commission.

Sadly, the Able sleepover wage theft debacle has come down to a conciliation this afternoon at the Fair Work Commission.
 
This has come about due to your employer deliberately refusing to provide us with the information we reasonably requested about how they have corrected serious underpayments.
 
Our request was quite simple:

  • How many sleepovers each of you performed
  • What days of the week you performed them
  • How many years they looked back
  • The methodology they used to work out the payment you received in the last pay run


We are concerned that Able hasn't done this right, we believe some of you will still be owed a substantial sum of money.

This has been deliberate action taken by Able to not engage with us, to hide the facts and try to avoid making the right payments.

Remember if you worked a sleepover that lasted longer than 8 hours the agreement is clear, you must be paid the right hourly amount for time exceeding those 8 hours. It appears that they have paid some proportion of the sleep over allowance - we think it's about a third of what they owe.
